1. Agreement to Terms

By accessing and using KickLift.ai (the "Service"), operated by Gocnet Technologies LLP ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

2. Description of Service

KickLift.ai is an AI-powered customer acquisition platform that helps businesses transform their expertise into content that attracts and converts customers. The Service includes content generation, management, and distribution features.

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for:

• Maintaining the security of your account and password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Acceptable Use

You agree not to use the Service to:

• Generate or distribute illegal, harmful, or offensive content
• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Attempt to gain unauthorized access to the Service
• Use the Service for spam or unsolicited communications

5. Content Ownership

You retain all rights to the content you create using our Service. By using KickLift.ai, you grant us a limited, non-exclusive license to process and display your content solely for the purpose of providing the Service to you.

6. Payment Terms

By subscribing to our paid services, you agree to the following payment terms:

6.1 Payment Authorization

By providing payment information, you authorize Gocnet Technologies LLP to charge your selected payment method for all fees and charges related to your use of the Service. You represent and warrant that you have the legal right to use any payment method you provide.

6.2 Recurring Billing

Subscriptions automatically renew unless cancelled before the renewal date. By subscribing, you authorize us to charge your payment method on a recurring basis (monthly or annually) until you cancel. You will be notified of any price changes at least 30 days before they take effect.

6.3 Payment Methods

We accept major credit cards, debit cards, and other payment methods as displayed during checkout. All payments are processed through secure, PCI-compliant payment processors. We do not store your complete payment information on our servers.

6.4 Taxes

Prices exclude applicable taxes and duties. You are responsible for all applicable taxes related to your use of the Service. Where required by law, we will collect and remit taxes on your behalf.

6.5 Failed Payments

If payment fails, we may retry charging your payment method. Continued failure may result in suspension or termination of your account. You remain responsible for any uncollected amounts.

6.6 Currency

All prices are listed in USD unless otherwise specified. Currency conversion fees may apply based on your payment method and location.

6.7 Refund Policy

All payments are non-refundable except as required by law or as explicitly stated in our Refunds and Cancellation Policy. No refunds will be provided for partial use of the Service.

7. Chargebacks and Disputes

We take payment disputes seriously and aim to resolve them fairly and promptly.

7.1 Chargeback Policy

If you initiate a chargeback or payment dispute with your bank or credit card company, we reserve the right to suspend or terminate your account immediately. You agree to pay all fees and costs associated with the chargeback, including any fees charged by our payment processor.

7.2 Dispute Resolution Process

Before initiating a chargeback, you agree to contact our support team at [email protected] to attempt to resolve any billing disputes. We will investigate and respond to your inquiry within 5 business days. Most disputes can be resolved without involving your financial institution.

7.3 Fraudulent Chargebacks

Filing a chargeback while continuing to use the Service, or filing a chargeback without first attempting to resolve the dispute with us, may be considered fraudulent. We reserve the right to take legal action to recover costs and damages associated with fraudulent chargebacks.

7.4 Evidence and Documentation

In the event of a payment dispute, you agree to provide all reasonable documentation and information requested to help resolve the matter. We maintain detailed records of all transactions and service usage to support dispute resolution.

8. Fraud Prevention and Security

We implement comprehensive measures to prevent fraud and protect all parties.

8.1 Account Security

You are responsible for maintaining the security of your account credentials. We may suspend accounts showing suspicious activity patterns. Multiple failed payment attempts or unusual usage patterns may trigger security reviews.

8.2 Transaction Monitoring

We monitor transactions for fraudulent activity using automated systems and manual reviews. Suspicious transactions may be delayed, blocked, or reversed. We reserve the right to request additional verification for high-risk transactions.

8.3 Identity Verification

We may require identity verification for certain account actions or transaction amounts. This may include government-issued ID, proof of address, or business documentation. Failure to provide requested verification may result in account limitations.

8.4 Prohibited Activities

Using stolen payment methods, creating multiple accounts to abuse promotions, or any form of payment fraud will result in immediate account termination and may be reported to law enforcement authorities.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

10. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Gocnet Technologies LLP and its licensors. The Service is protected by copyright, trademark, and other laws.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

12. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, and hereby disclaim all warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Limitation of Liability

In no event shall Gocnet Technologies LLP, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved in the courts of jurisdiction in India.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
